This policy sets out the basis on which any personal data we collect from you, or about you, from the member of the Portal (hereinafter the “Member”) on behalf of which you are accessing the Portal (defined below) will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. By visiting https://portal.pimento.co.uk (“the Portal”) you are accepting and consenting to the practices described in this policy.
For the purposes of the Data Protection Act 1998 and, when it comes into force, the General Data Protection Regulation ((EU) 2016/679) (GDPR) and all successor legislation to the Data Protection Act 1998 and the GDPR (the “Data Protection Legislation”), the data controller is the Portal Member (a company) which introduces you to us, or which provides us with the personal data.
INFORMATION WE COLLECT FROM YOU
We will collect and process the following data about you:
Information you give us. This is information about you that the Member which engages you gives us or that you provide to us on the Portal or by corresponding with us by phone, email or otherwise. It includes information about you provided to us when the Member which engages you registers to use the Portal, subscribes to or use our services and when you report a problem with the Portal. The information the Member and/or you give us may include your name, address, email address, phone number and company information.
Information we collect about you. With regard to each of your visits to the Portal we will automatically collect the following information:
- Technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;
- Search terms you have used on our Portal, a record of all browsing behaviour including links clicked. This is done via a cookie which is set on your first arrival to our Portal and the contents of any form you submit to us.
- All personal information disclosed by you to us, BUT we will not seek to append personal data from external sources
- Information about your visit, including the full Uniform Resource Locators (URL), clickstream to, through and from the Portal (including date and time), products you viewed or searched for page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any phone number used to call our customer service number.
- Information on engagement with the emails you receive from us.
- Some personal data may also be collected about you from the forms and surveys you complete, from records of our correspondence and phone calls.
- Pimento will only collect the information needed so that it can provide you with information about its clients’ services and its own, the business does not sell or broker your data, although coincidentally there may be times when your information could be contained in data that Pimento has purchased from a third-party list broker, on behalf of another client.
- Some of the collected items may contain personal data.
We will not be collecting:
- Information about browsing habits outside of our own domains (namely, portal.pimento.co.uk);
- Personal sensitive information relating to you and your private life, such as gender and age.
USES MADE OF YOUR INFORMATION
Pimento Portal uses the information collected from you to make telephone contact and to email you information which the business believes may be of interest to you. In you making initial contact you consent to Pimento maintaining a marketing dialogue with you until you either opt out (which you can do at any stage) or we decide to desist in promoting our services.
Pimento also acts on behalf of its clients in the capacity of data processor. When working as a data processor, Pimento will be acting on the instruction of its client and will work hard to ensure that the client is also fully GDPR compliant.
We use information held about you in the following ways:
Information the Member and/or you give to us. We will use this information:
- to carry out our obligations arising from any contracts entered into between the Member and us or to take steps at your request before entering into any contracts;
- to comply with any legal obligations to which we are subject;
- where it is necessary for our or a third party’s legitimate interests, including for the purposes of preventing fraud, except where such interests are overridden by your interests or fundamental rights and freedoms; or
- to protect your vital interests or those of another person.
If we intend to use your information for any other purpose, we will let you know what we intend to do with such data and the legal basis we are relying on for processing such data. This may include obtaining your express consent to the use of such data.
Information we collect about you. We will use this information:
- to administer the Portal and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
- to improve the Portal to ensure that content is presented in the most effective manner for you and for your computer;
- to allow you to participate in any interactive features within the Portal, when you choose to do so; or
- as part of our efforts to keep the Portal safe and secure.

DISCLOSURE OF YOUR INFORMATION
We will only pass on the personal data collected if we have a legal or contractual obligation to do so. However, Pimento may on occasion pass your Personal data to third parties exclusively to process work on its behalf. Pimento requires these parties to agree to process this information based on our instructions, confidentiality agreement and requirements consistent with this Privacy Notice and GDPR. Pimento does not broker or pass on information gained from your engagement with the business without your consent. However, Pimento may disclose your personal data to meet legal obligations, regulations or valid governmental request. The agency may also enforce its Terms and Conditions, including investigating potential violations of its Terms and Conditions to detect, prevent or mitigate fraud or security or technical issues; or to protect against imminent harm to the rights, property or safety of Pimento, its clients and/or the wider community.
You agree that we have the right to share your personal information with selected third parties including other members and potential clients:
- for the performance of any contract we enter into with the Member and/or you and for the provision of the service that the Member and/or you have asked for.
- if we are under a duty to do so in order to comply with any legal obligation;
- to protect yours or any other natural person’s vital interests; or
- where it is necessary for the purposes of the legitimate interests pursued by us or by a third party (except where such interests are overridden by your interests or fundamental rights and freedoms which require protection of personal data). This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
WHERE WE STORE YOUR PERSONAL DATA
All information the Member and/or you provide to us is stored on our secure servers in the UK and the Republic of Ireland and is encrypted.
Where we have given you (or where you have chosen) a password which enables you to access certain parts of the Portal, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to the Portal; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.
YOUR RIGHTS
Under the Data Protection Legislation:

You can ask us to rectify any inaccuracies in the personal information that we hold about you.

Should you wish to stop receiving emails from portal.pimento.co.uk, you can:
- Use the unsubscribe link, which will be present within the footer of every email we send to you. Your subscription preferences will be immediately updated.
- Write to the Pimento Data Controller, specifically requesting your removal (addressed to: Data Controller, Pimento, 34 Kingswick Drive, Ascot, SL5 7BQ), your request will be actioned upon within 28 days of its receipt. You must include your name and email address for us to ensure removal.
Please note we cannot accept unsubscribe requests through any other channel.

The Portal contains links to and from the websites of other members, and from time to time, our partner networks and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. The Data Protection Legislation gives you the right to access information held about you. Your right of access can be exercised in accordance with the Data Protection Legislation.
